Terms of Service

LocalTrial (“we”, “us”), operated by AVAIA, LLC, lists clinical studies run by independent research sites and passes the applications of people interested in them to the site running each study. These terms apply to everyone who uses LocalTrial. How we handle information is in our Privacy Policy.

LocalTrial is for people in the United States. You must be 18 or older to use it yourself. A parent or legal guardian may use it for someone under 18 in their care. If you sign up or apply for someone you care for, you confirm you have the right to act for them and to share their information.

• LocalTrial is not medical advice. Nothing on it is a recommendation to take part in any study or to change any treatment. Talk to your own doctor.
• We do not run studies. Each study is run by its sponsor and the research site listed on its page, which are independent of us and responsible for the study, its information and its care.
• Study information comes from the sites and from ClinicalTrials.gov, and parts are rewritten in plain language. We try to keep it accurate, but the study team has the final word.
• Applying is not agreeing to take part, and does not mean you will be contacted or enrolled. The site decides whom to contact, and a study can fill up or close at any time.
• Suggestions are worked out from what you tell us. They are not a judgment that a study is right or safe for you.

You sign in with a code we text to your phone. Give accurate information, keep your phone secure, and tell us at privacy@avaia.net if you think someone else has used your account.

LocalTrial's text messages, sent by AVAIA, LLC, are: the code that confirms your phone number; a confirmation when you apply to a study, with a link to its pre-screening questions; and, only if you choose them, alerts about new studies that may fit you. You agree to receive these by ticking the box for texts on the application form, or by turning alerts on.

• Message frequency varies.
• Message and data rates may apply.
• Reply STOP to any of our texts to stop receiving them. Reply HELP for help, or email privacy@avaia.net.
• Mobile carriers are not liable for delayed or undelivered messages.

A research site you apply to may also contact you about that study, under its own practices. We do not sell or share your SMS opt-in data or personal information with third parties for marketing purposes.

Don't:

• give false information, or apply for someone without their permission;
• use LocalTrial to collect information about other people, or to contact volunteers outside a study they applied to;
• copy or scrape the site in bulk, or interfere with how it works or its security;
• break the law using it.

We may suspend or close an account that does.

A site uses LocalTrial under the terms it accepts when it is approved, which these terms add to. In short: a site keeps a prepaid balance, and each study open to volunteers costs a set price for each day it is open, taken from the balance in advance. When the balance cannot pay for a day, the site's studies stop taking applications until it is topped up. A site is responsible for its study information, for having the approvals its studies need, for contacting volunteers only about the studies they applied to unless they agreed to more, and for protecting the information it receives as the law requires.

LocalTrial's name, logo, design and software are ours. Study information belongs to the sites and sponsors that provide it.

LocalTrial is provided “as is” and “as available”. To the extent the law allows, we make no warranties, express or implied, including that it will always be available or error-free, or that any study is suitable for you.

To the extent the law allows, we are not liable for indirect, incidental or consequential damages, or for anything a research site or sponsor does or fails to do, including in a study. Our total liability to a volunteer for any claim is limited to $100, and to a research site to what it paid us in the 12 months before the claim.

We may change these terms; we will update the date at the top, and tell you of a significant change before it applies. You can stop using LocalTrial at any time, and ask us to delete your account as the Privacy Policy describes.

These terms are governed by the laws of the State of Florida, without regard to its conflict-of-law rules.
